Conviction set aside, and retrial ordered due to unsafe verdict by jury

Fisher Dore Lawyers

Fisher Dore appeared for Mr N. He was convicted after trial of one count of indecent treatment, and acquitted on a second count of indecent treatment. He was sentenced to 6 months imprisonment, suspended after 3 months with an operational period of 12 months.

Mr N appealed on three grounds: the verdict of guilty was unsafe and unsatisfactory, there was a fundamental defect in the trial process, and the judge erred in directing the jury as to lies. Fisher Dore was responsible for the success of the appeal. The verdict of guilty was set aside and a retrial ordered.
