The Royal Commission and Institutional Abuse

Recent changes to the Limitation of Actions Act 1974 in Queensland relating to legal rights of survivors of child sexual abuse has meant that:-

  1. Time limits, that had the effect of preventing some survivors from being able to exercise some of their legal rights because of the amount of time that had passed since the abuse, no longer apply to survivors of child sexual abuse in Queensland and those survivors may now bring an action for damages at any time; and
  2. For some survivors of child sexual abuse, the recent changes in the law in Queensland may enable those survivors to bring an action for damages or costs at any time despite having already received damages or costs in relation to the abuse in the past.


    1. To fall within this category, the survivor must have received the damages or costs in the past at a time when the limitation period, that used to apply to claims by survivors, had expired.
    2. The fact that a survivor that falls within this category may have signed an agreement when they received damages or costs in the past, preventing the survivor from bringing any further action for damages or costs, does not prevent the survivor from now bringing a further action for damages or costs.
    3. If a survivor falls within this category, the amount of damages and costs that was paid to the survivor in the past may be taken into account in any further action for damages or costs.
